can we use premium wordpress theme for free?

I have a question about wordpress themes,i saw lots of paid themes for wordpress and after some more search i saw that same theme which is paid and it is for free there,so should i download that premium theme for free and install it on my website? is that illegal or he can put any kind of case on me for using it for without buying license for that theme..or i can use it?
